Rental Agreement

The Warm Regards Rental Agreement must be signed & returned prior to delivery.

IMPORTANT – PLEASE READ CAREFULLY

PLEASE REVIEW ALL PAGES OF THIS RENTAL AGREEMENT, INCLUDING THE TERMS & CONDITIONS AND LIABILITY WAIVER.

To confirm that you have read, agree to, and will abide by these Terms and Conditions, please sign at the bottom of your rental form. This Rental Agreement is not considered complete without signature and indicating that you read all pages.

RENTAL AGREEMENT FOR MOBILE SAUNA UNIT

Terms and Conditions

The Customer (hereinafter referred to as the “Renter” or “I”) wishes to reserve a mobile sauna unit (hereinafter referred to as the “Mobile Unit”) from Elevated Experiences, LLC, DBA Warm Regards Mobile Sauna (hereinafter referred to as “Warm Regards Sauna”), and therefore hereby agrees to the terms and conditions contained herein.

The Renter understands and agrees that Warm Regards Sauna must approve this Rental Agreement before a reservation can be confirmed. Upon approval, the Renter authorizes Warm Regards Sauna to charge the Renter’s credit card for the rental fee, refundable or non-refundable deposit, and/or for any damages incurred during the rental period.

Payment for rental of the Mobile Unit may also be made by cash or debit card. A credit card is required and must be kept on file for security purposes.

This Rental Agreement is for the temporary use of the Mobile Unit only and is limited exclusively to use at the rental location noted above. The Renter is strictly prohibited from moving, towing, or allowing any person or entity to move the Mobile Unit from the exact location where it was placed by Warm Regards Sauna at the time of delivery. Once in location, the Mobile Unit must remain leveled and chocked.

Warranties & Condition

Warm Regards Sauna makes no warranties, express or implied, regarding the Mobile Unit.

Warm Regards Sauna shall deliver and set up the Mobile Unit at the agreed-upon rental location on the rental start date and shall retrieve the Mobile Unit at the completion of the rental period.

Warm Regards Sauna shall provide instructions and orientation demonstrating proper and safe use of the Mobile Unit.

The Renter agrees to return the Mobile Unit to Warm Regards Sauna in the same condition and state of repair as when delivered. The Renter acknowledges that the Mobile Unit is in good working condition and free from visible damage, unless otherwise reported to Warm Regards Sauna at the time of delivery.

Warm Regards Sauna is not responsible for any lost, stolen, or damaged personal property belonging to the Renter or any other person during the rental period.

CONTRAINDICATIONS & HEALTH WARNINGS

Please Read Carefully Before Using the Sauna

Using a sauna to treat or cure disease is neither implied nor guaranteed. Do not attempt to self-treat any illness without consulting a physician.

  • Hydration: Hydration is mandatory. Electrolyte replacement beverages are strongly recommended before and after use.
  • Smoking: Smoking is strictly prohibited. Wood surfaces absorb smoke and cause damage and allergic reactions to future users.
  • Pregnancy: Pregnant persons should consult a physician before use due to potential fetal risk.
  • Pacemakers / Defibrillators: Persons with pacemakers or defibrillators must consult a physician prior to use.
  • Medications: Persons using prescription medications should consult a physician before sauna use.
  • Elderly: Elderly persons may have reduced heat tolerance. Consult a physician before sauna use.
  • Cardiovascular conditions: Conditions such as hypertension, hypotension, heart failure, or impaired circulation require extreme caution. Heat exposure increases heart rate and blood flow. Heart rate may increase approximately 30 beats per minute for each degree rise in body temperature.
  • Minors: All persons under the age of 18 must be supervised at all times by a responsible and competent adult.
  • Alcohol: Alcohol consumption is not advisable. Attempting to “sweat out” alcohol is unsafe and dangerous.
  • Impaired sweating: Conditions such as Parkinson’s, Multiple Sclerosis, Central Nervous System tumors, and diabetes with neuropathy may impair sweat function and increase risk.
  • Bleeding disorders: Hemophiliacs or those prone to bleeding should consult a doctor before use.
  • Fever: Any person with a fever or elevated body temperature should not use the sauna.
  • Heat insensitivity: Any person with insensitivity to heat should not use the sauna.
  • Menstruation: Heating the low back during menstruation may temporarily increase menstrual flow. Some may find pain relief; others may choose to avoid sauna use during this time.
  • Joint injury: Recent or acute joint injuries should not be heated within the first 48 hours or while hot and swollen.
  • Enclosed infections: Vigorous heating is strictly contraindicated in cases of enclosed infections, including dental or joint infections.
  • Implants: Individuals with implants of any type should consult a physician before using the sauna.

Use common sense: Any person using the sauna shall at all times exercise common sense and use extreme caution to avoid any risks or harm to themselves or others.

Prohibited Use and Activities in the Mobile Unit
  • No alcohol consumption
  • No drugs or illegal substances
  • No smoking
  • No horseplay, rough or aggressive movement
  • No breakable items such as glass, bottles, ceramic plates, or dishes
Time Management of Sauna Use

Saunas do not require a large amount of time to reap benefits. A healthy person should spend about 10 to 15 minutes inside per session. Time should be shortened immediately if any shortness of breath, nausea, dizziness, or discomfort is experienced.

Burns
  • Do not touch the stove or stove rocks when the stove is in use or recently used.
  • Do not touch the metal behind the sauna stove. Use heat-resistant gloves and tools to handle hot components of the stove, including the air vent.
  • Remove all jewelry before entering the sauna, as metal can heat up and cause burns.

CANCELATION POLICY

  • Cancelation by the Renter must be made in writing at least 14 days before the rental start date to receive a full refund.
  • Less than 14 days’ notice: a 50% refund will be issued, or a full credit to re-book.
  • Less than 48 hours’ notice: no refund will be issued.

DELIVERY & SAFETY CONDITIONS

Warm Regards Sauna reserves the right to cancel this agreement at any time before or during the rental term in the event of unanticipated or unforeseeable circumstances, or if it deems there has been a breach of this agreement.

When renting the sauna, the Renter is required to have a solid, level surface to house the sauna, which is clear of any debris. For safety, the team member delivering the sauna has the right to refuse rental if there is no safe place to leave the sauna, including being able to access the entrance ways, and/or have adequate space around the unit. No refund will be issued under this circumstance.

CARING FOR THE SAUNA

  • A designated Operator is to be assigned and is responsible for the safe functioning of the sauna during sessions. If this individual is different from the Renter, the Renter is responsible for the oversight of the Operator. Both the Renter AND Operator must be familiar with the USER MANUAL, be shown & understand how to safely operate the sauna. The sauna should not be used without a trained Operator present.
  • All persons are recommended to use a thick cotton or terry cloth towel, folded double, on every bench for comfort and to absorb perspiration, oils, and salts.
  • Keep the Mobile Unit free of chemicals and any sharp or loose objects that may cause injury or slips and falls.

Always use common sense, be careful, and remain vigilant at all times.

UNDERAGE PERSONS

The Renter shall be fully responsible and liable for ensuring that any person under the age of 18 years (an “Underage Person”) has the expressed and explicit consent of a parent or legal guardian to use the Mobile Unit, and that such use is under strict and vigilant supervision by the Renter or another competent, capable, and mature adult.

I agree to release, indemnify, defend and hold Warm Regards Sauna harmless from all liabilities and future claims presented by my children or any other minor children and/or their parents, whose visit to Warm Regards Sauna’s equipment is sponsored by me, for any losses suffered by them or any family member or registered domestic partner. This includes any claim of the minor and any claim arising from the negligence of Warm Regards Sauna.

WAIVER AND RELEASE OF LIABILITY

SECTION 1: RELEASE OF LIABILITY AND ASSUMPTION OF RISK – I understand and acknowledge that there is risk involved in being in and around Warm Regards Sauna’s equipment, including, but not limited to, utilizing equipment that may malfunction or break, participating in any exercise or fitness activity, patronizing or using Warm Regards Sauna’s services, facilities and/or amenities, participating in programs or activities, and using or being present in and/or around any Warm Regards Sauna’s equipment while stationary or in transit (towing) or arising from improper maintenance of any equipment or facilities. This includes, without limitation, my use of the changing room, sauna, outdoor stairs, all seating, shower, parking area, sidewalk or any equipment inside or outside of the Warm Regards Sauna’s equipment and my participation in any activity, class, program or instruction. I agree that I am voluntarily participating in these activities and using the equipment and premises and assume all risk of injury, the contraction of any illness or medical condition that might result, or any damage, loss or theft of any personal property, whether any of the foregoing are suffered by me and/or my family members.

ASSUMPTION OF RISK. I agree that I will assume the risk and full responsibility for any and all injuries, losses, death, costs, the contraction of any illness or medical condition that might result or other damages, loss or theft of any personal property that might occur to me and/or my family members while inside or outside of the Warm Regards Sauna’s equipment, utilizing equipment which may malfunction or break, participating in any exercise or fitness activity, patronizing or using Warm Regards Sauna services, facilities and/or amenities, participating in programs or activities, using or being present inside and outside of any Warm Regards Sauna’s equipment, or arising from improper maintenance of any equipment or facilities, my use of the changing room, sauna, outdoor stairs, seating, shower, parking area, sidewalk or any equipment inside or outside of the Warm Regards Sauna equipment; my participation in any activity, class, program or instruction, and negligence on the part of Warm Regards Sauna, its officers, directors, employer contractors, agents and other members, including premises liability claims and/or equipment liability claims such as (by example and not by limitation) slip and falls and/or trip and falls inside or outside of any Warm Regards Sauna equipment. (“Losses”) THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. READ THE ENTIRE DOCUMENT CAREFULLY BEFORE SIGNING.

TERMS AND CONDITIONS Elevated Experiences, LLC, DBA Warm Regards Sauna, 2 Snowdin Ridge, York, Maine 03909 (b) RELEASE OF CLAIMS. To the maximum extent allowed by law, I, the undersigned (“I”), agree on my own behalf and on behalf of my family, personal representatives, heirs, executors, administrators, agents and assigns, to waive and release any and all claims, suits or related causes of action against Warm Regards Sauna. Warm Regards Sauna and Elevated Experiences, LLC, its owners, officers, employees, for all Losses (“Released Claims”). I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS RELEASE OF CLAIMS AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I AM WAIVING ANY RIGHT I MAY HAVE TO BRING A LEGAL ACTION TO ASSERT A CLAIM AGAINST WARM REGARDS SAUNA (Mobile Sauna Rental) and Elevated Experiences, LLC, FOR ITS NEGLIGENCE.

INDEMNIFICATION AND WAIVER

INDEMNIFICATION – I agree that I will indemnify, defend and hold Warm Regards Sauna harmless, to the maximum extent allowed by law, from negligence, injury, loss, death, costs or other damages to me, my family members, heirs or assigns, or third parties for claims, suits, or related causes of action asserted against Warm Regards Sauna Mobile Sauna Rental arising from my conduct and/or my family’s conduct while inside or outside of Warm Regards Sauna’s equipment or participating in any program or activity and from any of the Losses and Released Claims described in SECTION 1.

APPLICATION – I agree that this Release shall apply to each visit I make to Warm Regards Sauna’s equipment and to every instance of my participation in a program or activity, including future visits and participation, regardless of the date that this Release is signed below.

AGREEMENT TO COMPLY WITH RULES – I agree to, and will comply with, the policies of Warm Regards Sauna’s “USER MANUAL” posted in hard copy inside of the changing room, and with the policies of Warm Regards Sauna’s “RENTAL AGREEMENT”. I acknowledge that Warm Regards Sauna’s policies are subject to change at the sole discretion of the Warm Regards Sauna.

BINDING ON OTHERS – This Release shall bind the members of my family and my spouse or registered domestic partner if I am alive, as well as my estate, family, heirs, administrators, personal representatives or assigns if I am deceased and shall be deemed as a “Release, Waiver, Discharge and Covenant” not to sue Warm Regards Sauna.

SEVERABILITY – I agree that the purpose of this Release is that it shall be an enforceable release of liability and indemnity as broad and inclusive as is permitted by Maine law. I agree that if any portion or provision of this Release is found to be invalid or unenforceable, then the remainder will continue in full force and effect. I also agree that any invalid portion will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of the Release.

APPLICABLE LAW, FORUM & ATTORNEYS’ FEES – This Release is governed by and shall be construed in accordance with the laws of the state of Maine, without any reference to its choice of law rules. I agree that any dispute arising from this Release or in any way associated with Warm Regards Sauna doing business within the state of Maine or outside of the state of Maine shall be brought only in the Courts of York County, Maine, and I agree to the jurisdiction and venue of those courts for any such dispute. In any litigation in which the validity or enforceability of this Release is contested, I agree that the substantially prevailing party will be entitled to receive all attorney’s fees and costs from the party contesting the validity of this Release. I acknowledge that no oral representations, statements, or other inducements to sign this Release have been made apart from what is contained in this document. I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS RELEASE BY READING IT BEFORE SIGNING IT. BY MY SIGNATURE BELOW I UNDERSTAND AND AGREE TO THE ABOVE TERMS AND CONDITIONS, AND TO ALL POLICIES CONTAINED IN WARM REGARDS SAUNA’S “USER MANUAL” AND “RENTAL AGREEMENT”, WHICH I HAVE READ. THESE POLICIES ARE SUBJECT TO CHANGE FROM TIME TO TIME SOLELY AT THE DISCRETION OF WARM REGARDS SAUNA.
